Terms and Conditions for Purchasing-Selling Goods in the Maxptt.com Online Store

1. Definitions

1.1 Seller UAB “Samlita” (hereinafter “Samlita”) – A private legal entity registered in the Register of Legal Entities of the Republic of Lithuania at the Vilnius branch of the State Enterprise “RegistrĹł centras,” with legal entity code 305200381, VAT payer code LT100012565610, registered office address P. Lukšio St. 32, LT-08222 Vilnius, whose goods are sold on the website www.maxptt.com in accordance with these Terms and which is responsible for fulfilling the Buyer’s order.

1.2 maxptt.com – The website located at www.maxptt.com, where goods are sold and administered by Samlita. In these Terms, it is also understood as the Seller in relation to the goods sold.

1.3 Buyer – 1) A legally competent natural person (i.e., an adult whose legal capacity is not restricted by a court); 2) A minor aged 14 to 18 with parental or guardian consent; 3) A legal entity.

1.4 Parties – The Buyer and Seller collectively.

1.5 Personal Data – Any information about a natural person whose identity is identified or identifiable (data subject). A natural person whose identity can be determined directly or indirectly through identifiers such as name, personal identification number, location data, online identifiers, or physical, physiological, genetic, mental, economic, cultural, or social identity characteristics.

1.6 Terms – These “Terms for Purchasing-Selling Goods on maxptt.com,” which apply to every Buyer’s purchase on maxptt.com and every Sales Agreement between the Buyer and Seller.

1.7 Account – The result of the Buyer’s registration on maxptt.com under these Terms, creating a personal account storing the Buyer’s data and order history.

1.8 Privacy Policy – A document approved by Samlita outlining the rules for collecting, storing, processing, and retaining Personal Data when using maxptt.com. Samlita’s Privacy Policy does not cover data processing by the Seller.

1.9 Agreement – A Sales Agreement between the Buyer and Seller, deemed concluded upon order confirmation. The terms of each Agreement are identical to these Terms.

1.11 Order – A request specifying the goods the Buyer wishes to purchase from the Seller.

2. General Provisions

2.1 By checking the box “I have read and agree to the maxptt.com purchasing-selling Terms,” the Buyer confirms acceptance of these Terms as a binding legal document.

2.2 The Buyer accepts these Terms upon creating an account on maxptt.com. Updated Terms apply from their publication on www.maxptt.com.

2.3 Only Buyers defined in Section 1.3 may purchase goods on maxptt.com.

2.4 Samlita reserves the right to modify the Terms under Lithuanian law. Buyers are notified via their Account or during checkout.

2.5 The Buyer must review Samlita’s Privacy Policy. Personal Data is processed in compliance with legal requirements.

2.6 The Buyer is responsible for ensuring the accuracy of their provided email address for communications.

3. Order Placement and Contract Formation

3.1 Orders may be placed:

  • 3.1.1 By registering on maxptt.com.
  • 3.1.2 Without registration.

3.2 The Buyer must provide accurate personal data for order fulfillment.

3.3 Orders are subject to the Privacy Policy and these Terms.

3.4 A Sales Agreement is formed when the Buyer completes checkout. Confirmation is sent via email.

3.5 Product instructions in Lithuanian will be provided upon delivery.

3.6 Orders are stored in Samlita’s database per the Privacy Policy.

4. Buyer’s Rights

4.1 The Buyer may purchase goods and services on maxptt.com.
4.2 The Buyer may cancel an order or Agreement under these Terms.
4.3 The Buyer may exchange or return goods as specified.
4.4 Other rights under Lithuanian law apply.

5. Buyer’s Obligations

5.1 The Buyer must comply with these Terms, Privacy Policy, and applicable laws.
5.2 The Buyer must pay for and accept ordered goods.

6. Seller’s Rights

6.1 Samlita may cancel unpaid orders after 3 business days.
6.2 Samlita may contact the Buyer for clarifications regarding payment.
6.3 The Seller may split orders into separate shipments.

7. Seller’s Obligations

7.1 The Seller must fulfill orders and communicate via maxptt.com.
7.2 The Seller must provide clear product information.
7.3 Samlita must protect the Buyer’s privacy.
7.4 Samlita must notify Buyers of significant service changes.
7.5 The Seller must accept returned goods under these Terms.

8. Pricing and Payment

8.1 Prices are in EUR, including VAT.
8.2 Payment methods: electronic banking, bank transfer, cash on delivery, credit, or other methods listed on maxptt.com.
8.3 Orders are confirmed upon payment receipt.
8.7 An administrative fee of €2.49 (incl. VAT) applies for orders below €9.99.

9. Delivery

9.1 Delivery methods are specified per product.
9.2 Home delivery requires accurate address and recipient availability.
9.4 In-store pickup must occur within 3 business days of notification.
9.5 Fedex delivery applies for all items.
9.6 Delivery times are approximate. Delays due to unforeseen circumstances may occur.

10. Product Quality and Warranty

10.1 Product descriptions are provided on maxptt.com.
10.2 Goods must match descriptions and be fit for purpose.
10.8 Electronics carry a 24-month warranty.

11. Returns and Exchanges

11.1 The Buyer may withdraw from the Agreement within 14 days of delivery.
11.2 Extended 30-day return guarantee applies for unused items in original packaging.
11.3 Exchanges for size, color, or model are permitted within 14 days.
11.4 Defective goods may be returned for repair, replacement, or refund.

12. Liability

12.1 The Buyer is responsible for unauthorized account use.
12.4 Samlita is not liable for third-party website content.

13. Promotions

13.1 Samlita may initiate promotions or games at its discretion.
13.3 Terms of promotions may be modified or canceled without notice.

14. Communication

14.1 All communication occurs via maxptt.com.
14.2 Notifications are sent to the Buyer’s registered email or phone.

15. Final Provisions

15.1 These Terms are governed by Lithuanian law.
15.3 Disputes are resolved through negotiation or Lithuanian courts.
15.4 Complaints may be submitted to the State Consumer Rights Protection Authority.
